Luciato Terms of Service

Effective Date: April 11, 2026

These Terms of Service ("Terms") govern your use of Luciato for iPhone and Mac, including the iOS app, the iOS keyboard extension, and the macOS app. Luciato is provided by Tutelon LLC ("Tutelon," "we," "our," or "us"). By downloading, accessing, or using Luciato, you agree to these Terms.

1. License and Eligibility

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Luciato for your personal or internal business use in accordance with the app's intended purpose. You may not copy, resell, reverse engineer, distribute, or misuse Luciato except as allowed by applicable law.

2. What Luciato Provides

Luciato offers dictation and AI-assisted writing features across iPhone and Mac. Depending on your platform and settings, Luciato may provide cloud transcription, local transcription, AI Draft output, optional auto-insert or clipboard workflows, settings sync, diagnostics, and subscription-gated cloud features.

3. Cloud Features and AI Output

• Cloud features may process your recorded speech, dictated text, AI Draft instructions, and related request context to produce output.
• Speech recognition and AI-generated output can be inaccurate, incomplete, misleading, or inappropriate for your purpose. You are responsible for reviewing all output before using, sharing, or relying on it.
• Luciato is not a substitute for professional judgment. Luciato's AI Draft and dictation features are not intended to provide medical or legal advice.
• You may not use Luciato to violate the law, infringe the rights of others, distribute harmful content, or attempt to abuse or interfere with the service.

4. Your Content

You retain your rights in the audio, text, and instructions you submit to Luciato. You grant us and our service providers a limited right to host, transmit, process, and use that content solely as needed to operate Luciato, provide the requested features, secure the service, and comply with law. You represent that you have the rights needed to submit that content.

5. Subscriptions, Billing, and Trials

• Some Luciato cloud features require a paid subscription or trial.
• Subscriptions are billed through Apple using StoreKit and are subject to Apple's billing, renewal, cancellation, refund, and account rules.
• Prices, trial availability, renewal terms, and subscription benefits are shown in the app and/or on the App Store at the time of purchase.
• Auto-renewable subscriptions renew automatically unless canceled through your Apple account before renewal.

6. Apple Platform Terms

If you downloaded Luciato from an Apple App Store, your use is also subject to the applicable App Store terms. Apple is not responsible for Luciato's operation or support beyond any obligations imposed by applicable law or App Store rules.

7. Availability, Updates, and Changes

We may update Luciato, change features, adjust service limits, modify subscription offerings, or stop offering some or all features at any time. We may also require updates to continue using certain features. Some features depend on third-party services, internet access, Apple platform capabilities, or supported operating system versions.

8. Acceptable Use

You agree not to:

• use Luciato in a way that violates law or another person's rights;
• attempt to bypass subscriptions, quotas, app integrity protections, or security controls;
• probe, overload, or disrupt Luciato's infrastructure or connected services;
• submit malicious code, abusive traffic, or content you are not authorized to process; or
• use Luciato in high-risk situations where errors could reasonably cause injury or significant harm.

9. Privacy

Your use of Luciato is also governed by the Luciato Privacy Policy, which explains how Luciato handles data, consent, retention, deletion requests, diagnostics, and service providers.

10. Disclaimers

Luciato is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, perfect transcription accuracy, error-free AI output, or that Luciato will meet every workflow, compatibility, or security requirement you may have.

11. Limitation of Liability

To the fullest extent permitted by law, Tutelon LLC and its affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business opportunity arising from or related to your use of Luciato. Our total liability for claims arising out of or related to Luciato will not exceed the greater of the amount you paid for Luciato in the 12 months before the claim arose or USD $50.

12. Suspension and Termination

We may suspend or terminate access to Luciato or its cloud features if we reasonably believe you are violating these Terms, creating legal risk, abusing the service, or interfering with other users or our systems.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here and change the effective date above. Continued use of Luciato after the updated Terms take effect means you accept the revised Terms.
